Principal Trademark

a person's business


Certification Trademark

1. Registration Period: 10 years
2. Definition: Exclusive use of a mark to certify, by providing knowledge or
technology, the cha
racteristics, quality, precision or other matters
of another person's goods or services


Collective Trademark

1. Registration Period: 10 years
2. Definition: Exclusive use of a mark by a business association, club or
social organization, or anyone of other groups to distinguish its
organization or memberships.


Requirement for Filing an Application

1. Power of Attorney, signed by the applicant.
2. Trademark Specimen.
3. Specification of class and goods or services in according to International
Classification of Goods and Services. Each trademark application may
cover more than one class.
4. The Name, Address, Nationality of the applicant and the representative of
a company (if any).
5. Priority documents (if priority is claimed).


Remark:

1. To get an earlier filing date, facsimile copies of items 2, 3 and 4 above are
acceptable for provisional filing, but original and appropriate documents of
items 1 and 5 must be supplemented within three months from the filing
date.
2. The registration of a trademark shall be canceled, if the trademark has not
been put into use for three years after registration without goods reasons or
has been continuously suspended from use for three years, except that an
associated trademark has been put in use for the same goods or a licensed
user has used the trademark.

An individual cannot file the application of certification mark /collective
mark.


Renewal of Registration Term

For those trademarks that only pay the first installment of registration fee at registration, the applicant must pay the second installment of registration fee any time before the expiration of three years. In case the second installment due is not paid within the regulatory period for payment, it may be paid later within six months after expiry of the said regulatory period provided that the amount of late payment shall be twice as much as the regular amount of second installment of registration fee.
A renewal application for extending the term of the right to the exclusive use of a trademark shall be filed within six months before or after the expiration of the ten year protection term. For those renewal applications filed within six months after the expiration of the term, the renewal fee shall be doubled.
The renewal application shall be approved only for the continuous use of the trademark on those goods which are designated in the trademark registration and on which the trademark has actually been put to use.
